“Not guilty” of criminal organization charges

  1. After lengthy and large police investigation involving wiretap authorizations, the accused was arrested and charged with drug trafficking offences as well as participating in a criminal organization.  The prosecution alleged that the accused was a participating member of large and dangerous criminal gang -- a criminal organization, as defined in the Criminal Code.  The accused maintained that was not a member of the criminal organization, but that he trafficking small amounts of drugs and grew up with people who part of the gang.  Through cross-examinations and legal submissions at trial before a jury in the Superior Court, the defence was able to undermine the prosecution’s case regarding the criminal organization charges.  The jury found the accused “not guilty” of the criminal organization charges.
